Topic: Cryptocurrency Fraud

The fraudulent and illegal activities in issuing and trading of cryptocurrencies is staggering.  Over 1,500 “coins” are trading with new “coins” added almost daily.  Experts estimate that 80% to 90% of all new initial coin offerings (“ICO”) are fraudulent.  One market website lists over 5,000 frauds in cryptocurrencies. Billions of dollars are being raised to invest in ICOs.

The SEC, FTC, and CFTC along with state regulatory and law enforcement agencies have established task forces or specialized committees to investigate, regulate, or when necessary, enjoin investments or operations involving cryptocurrencies.  In addition, the IRS is pursing the tax cheats and only a very small percentage of investors have reported profits to the IRS.  Fraud investigators need to be cognizant of the schemes, illegal offerings, and related frauds.

Our panel will provide a brief introduction to cryptocurrencies and blockchain technology while focusing on the fraudulent activity. Greg Hays and Henry Sewell will discuss the current regulatory environment including cases that have recently been filed by various regulatory agencies to shut down and recover funds for duped investors. In addition, they will address security perfection issues in UCC’s and tax matters.  David Silver will discuss the private class actions in coin offerings he has filed. David is one of the leading lawyers in America representing investors who have invested in digital assets and is a frequent speaker and guest on television programs regarding cryptocurrencies.  

 

Biographies

 

S. Gregory Hays 

Greg is a court appointed fiduciary and forensic accountant that specializes in recovering funds from insolvent companies and investment offerings. He is routinely appointed by federal and state courts as a receiver or bankruptcy trustee to maximize recoveries for creditors. He is President of the National Association of Federal Equity Receivers and serves on the Board of the Association of Insolvency & Restructuring Advisors. Henry F. Sewell, Esq

Henry focuses his practice in the areas of bankruptcy and restructuring while also maintaining a general commercial litigation practice.  He has extensive experience representing debtors, creditors, creditors’ committees, trustees and examiners in complex Chapter 11 Bankruptcy Cases and in pre-bankruptcy workouts.  Henry has also represented financial institutions and secured creditors in state court enforcement actions, including actions to appoint receivers for commercial real estate and foreclosure actions.  He also regularly represents court appointed fiduciaries in SEC and CFTC enforcement actions.
 

Henry has extensive experience handling commercial litigation matters, including trials, arbitrations and appeals in a wide variety of complex matters.  He has handled complex and difficult disputes regarding real estate, breach of contract, business torts, and corporate governance.  In addition, he also has particular experience litigating disputes regarding governance and control of limited liability companies; disputes regarding title and claims to real estate; and extraordinary remedies including temporary restraining orders, preliminary and permanent injunctions and declaratory relief.

Henry has been recognized by Chambers USA as one of Georgia’s leading lawyers for bankruptcy and restructuring and has been named a Georgia Super Lawyer since 2010 by Atlanta Magazine. 


 

David Silver

David is a founding Partner of Silver Miller and is focused on representing aggrieved investors and cryptocurrency users worldwide who seek to recover their financial losses.
